Begini Cara Ubah Girik Jadi Sertifikat Tanah yang Sah<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Kepemilikan tanah harus tertandai dengan adanya surat yang sah di mata hukum. Surat-surat tanah yang saat ini berlaku di Indonesia cukup beragam dan banyak jenisnya. <\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Salah satu yang sering orang pikir sebagai surat sah adalah Girik. Sayangnya, Girik tidak menjamin kepastian hukum soal hak kepemilikan kamu atas tanah.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large is-resized\"><img data-recalc-dims=\"1\" fetchpriority=\"high\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/2.bp.blogspot.com\/-dF07CYBDYdw\/UPaTpaVjPxI\/AAAAAAAAAGo\/ZxhjD4qrJvM\/s1600\/Ipeda-1983.jpg?resize=715%2C464&#038;ssl=1\" alt=\"Begini Cara Ubah Girik!\" width=\"715\" height=\"464\"\/><\/figure>\n<\/div>\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Sehingga bagi kamu yang memiliki tanah Girik, sebaiknya segera lakukan pengubahan menjadi sertifikat tanah yang sah. Sebagai informasi, Girik sendiri adalah semacam bukti hak pembayaran pajak pada masa lampau atau sekitar tahun 1990-an.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Undang-Undang Pokok Agraria (UUPA) tidak menyebut secuil pun tentang Girik. Artinya bukan termasuk sertifikat hak atas tanah yang berkekuatan hukum tetap.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Hak atas tanah yang terakui hanyalah hak milik, hak guna bangunan (HGB), hak guna usaha (HGU), hak atas satuan rumah susun (HMSRS), hak pakai, serta hak pengelolaan.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Merujuk Peraturan Pemerintah (PP) Nomor 24 Tahun 1997 tentang Pendaftaran Tanah, khususnya pada Pasal 24. Di situ tertulis, untuk keperluan pendaftaran, hak atas tanah yang berasal dari konversi hak-hak lama, pembuktian dengan alat-alat bukti mengenai hak tersebut.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Yaitu berupa bukti-bukti tertulis, keterangan saksi dan\/atau pernyataan yang bersangkutan. Salah satu alat bukti tertulis yang termaksud ialah girik.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Selanjutnya melansir informasi situs resmi Indonesia.go.id, terdapat dua tahapan mengurus sertifikat tanah Girik. Yaitu pengurusan di kantor desa\/kelurahan dan kantor pertanahan.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Cara Ubah Girik di Kantor Desa\/Kelurahan<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Ketika mengurus di kantor desa\/kelurahan setempat, pemohon perlu memastikan dan membuat tiga surat keterangan atau pernyataan.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Pertama yakni surat keterangan tidak sengketa. Di dalamnya mencantumkan tanda tangan saksi-saksi seperti pejabat RT dan RW atau tokoh masyarakat setempat. Prinsipnya, saksi mengetahui informasi sejarah penguasaan tanah.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Setelah itu, pemohon juga perlu membuat surat keterangan riwayat tanah. Isinya menerangkan riwayat penguasaan tanah awal mula pencatatan di desa\/kelurahan hingga saat ini.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Terakhir, pemohon membat surat keterangan penguasaan tanah secara sporadik. Mencantumkan tanggal pemohon saat memperoleh atau menguasai bidang tanah tersebut.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Mengurus di Kantor Pertanahan<\/h2>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Sebelum menuju kantor pertanahan, pemohon perlu menyiapkan beberapa dokumen persyaratan. Melansir dari laman resmi Kementerian ATR\/BPN, berikut rinciannya:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Formulir permohonan yang sudah pemohon isi, dan ditandatangani pemohon atau kuasanya di atas materai;<\/li><li>Surat kuasa apabila pengurusan oleh kuasa;<\/li><li>Fotokopi identitas pemohon (KTP, KK) dan kuasa apabila pengurusan oleh kuasa, yang telah cocok dengan aslinya menurut petugas loket;<\/li><li>Bukti pemilikan tanah\/alas hak milik adat\/bekas milik adat;<\/li><li>Foto copy SPPT PBB Tahun berjalan yang telah cocok dengan aslinya menurut petugas loket dan penyerahan bukti SSB (BPHTB);<\/li><li>Melampirkan bukti SSP\/PPh sesuai dengan ketentuan;<\/li><li>Keterangan berupa luas, letak, dan penggunaan tanah; pernyataan tanah tidak sengketa; dan pernyataan tanah\/bangunan  pemohon kuasai secara fisik.<\/li><\/ol>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Dokumen persyaratan tersebut kemudian serahkan kepada petugas di loket pelayanan kantor pertanahan untuk pemeriksaan. Setelah itu, pemohon menuju loket pembayaran untuk membayarkan biaya pendaftaran, pengukuran, dan pemeriksaan tanah.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Tahapan selanjutnya, petugas dari kantor pertanahan akan melakukan pengukuran dan pemeriksaan bidang tanah yang pemohon daftarkan. Pemohon harus hadir dalam proses ini.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Kemudian, kantor pertanahan akan mengumumkan hasil pengukuran untuk mengakomodir apabila ada pihak yang keberatan. Durasinya sekitar 60 hari. Pengumuman itu terpasang di beberapa tempat yang perlu. Misalnya di kantor pertanahan, kantor desa\/kelurahan, ataupun media massa.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Apabila tahapan tersebut selesai dan tidak bermasalah, maka kantor pertanahan akan melakukan pembukuan hak dan penerbitan sertifikat tanah. Sehingga, pemohon sudah dapat mengambil sertifikat tanah di loket pelayanan kantor pertanahan.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Adapun waktu penyelesaian mengurus atau mengubah girik menjadi sertifikat tanah di kantor pertanahan sekitar 98 hari kerja.
